This Notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Our Legal Duty

SANA Psychiatric Associates is required by law to maintain the privacy of your Protected Health Information (PHI), provide you with this Notice, and follow the terms of the Notice currently in effect.

How We May Use and Disclose Your Information

We may use and disclose your PHI for the following purposes without your written authorization:

Treatment
To provide, coordinate, or manage your mental health care, including sharing information with other healthcare providers involved in your treatment.

Payment
To bill and receive payment from insurance companies or other payers and to determine eligibility and coverage.

Healthcare Operations
For administrative, legal, quality improvement, training, and business operations necessary to run the Practice.

Special Protections for Mental Health & Psychotherapy Notes

Psychotherapy notes, when created, are maintained separately from the general medical record and receive additional protections under federal law. Psychotherapy notes are not released without your specific written authorization except as required by law.

Substance Use Disorder Records (42 CFR Part 2)

If your treatment includes information related to a Substance Use Disorder, additional federal privacy protections may apply. In many cases, a separate written authorization is required before such information can be disclosed.

Other Permitted or Required Disclosures

We may disclose PHI:

  • When required by law
  • To prevent serious harm to you or others
  • For public health activities
  • For health oversight, audits, or investigations
  • In response to a court order or subpoena
  • To report suspected abuse, neglect, or domestic violence as required by Texas law

Your Rights

You have the right to:

  • Inspect and obtain a copy of your medical records
  • Request corrections
  • Request restrictions (not all requests must be agreed to)
  • Request confidential communications
  • Receive a list of certain disclosures
  • File a complaint without retaliation

Requests must be submitted in writing.

Breach Notification

You will be notified if a breach of unsecured PHI occurs as required by federal and Texas law.

Changes to This Notice

We reserve the right to change this Notice. The updated Notice will be posted on our website and available in our office.
